These Terms and Conditions ("Terms") apply to your use of www.sanitaryequipment.com (the "Site") and to purchases made through the Site from Sanitary Equipment Company Inc. ("SECI," "we," "us" or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
Using the Site
- You must be at least 18 years old, or the age of majority where you live, to place an order.
- Use the Site only for lawful purposes. Do not try to gain unauthorized access to the Site, interfere with how it works, upload malicious code, or copy or scrape Site content for commercial use without our written permission.
- We may suspend or end access to the Site for anyone who violates these Terms.
Accounts
You are responsible for keeping your account sign-in secure and for activity under your account. Tell us promptly if you think someone has used your account without permission.
We review business account applications and may approve or decline any application. Pricing, payment terms and other terms for a business account may be set in a separate written agreement. If that agreement conflicts with these Terms, the agreement controls.
Products, Descriptions and Fitment
We work to describe products accurately, but descriptions, specifications and images may contain errors, and some images are representative. Manufacturer names, numbers, symbols and descriptions are used for reference purposes only.
Please confirm that a part fits your equipment before you order. Our Parts Department can help confirm fitment using your equipment make, model and serial number.
Prices, Quotes and Orders
- Prices, availability and product information can change without notice.
- Equipment and some parts are sold by quote. A quote applies only for the period and on the terms it states.
- Your order is an offer to buy. We may accept, limit or cancel an order, including after you place it, for example if a price or description is wrong or a product is not available. If we cancel an order you have paid for, we will refund the amount charged for the canceled items.
- We may correct errors in prices, descriptions or availability at any time.
- Taxes and shipping charges for online orders are shown at checkout.
Payment
Online orders are paid at checkout using the payment methods shown there, and payments are processed by our payment processors. Payment terms for business accounts are set by agreement.
Shipping and Returns
Shipping is covered by our Shipping Policy, and returns by our Return and Refund Policy.
Disclaimer of Warranties
Except for any warranty stated in a written quote or sales agreement from SECI, the Site and all products are provided "as is." SECI makes no other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose.
Limitation of Liability
To the fullest extent permitted by law, SECI is not liable for any special, incidental, indirect or consequential damages, including lost profits, downtime or loss of use, arising from the Site or any product, even if we were told such damages were possible. Some states do not allow these limits, so they may not apply to you.
Indemnification
You agree to defend and hold harmless SECI and its owners, employees and agents from claims, including reasonable attorneys' fees, that arise from your breach of these Terms or your misuse of the Site.
Site Content and Other Websites
The text, photos, graphics and logos on the Site belong to SECI or its licensors and may not be copied for commercial use without permission. Manufacturer names and logos belong to their owners. Links to other websites are provided for convenience, and we are not responsible for their content or practices.
Privacy
Our Privacy Policy explains how we handle personal information.
Governing Law
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of law rules.
Changes to These Terms
We may update these Terms by posting a new version on this page. The version posted when you place an order applies to that order.
General
If any part of these Terms cannot be enforced, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. These Terms, the policies they refer to and any written agreement with SECI are the entire agreement between you and SECI about the Site.
